This Statement applies globally to all Expansion Americas’s operations and sites. However, for certain regions, products or services, specific privacy notices may apply instead of, or to complement this Statement.

If you apply for a job with Expansion Americas, note that these Privacy Statements apply to personal information we process to manage your application.

Expansion Americas acting on behalf of third parties

You may provide personal or professional information to third parties selling Expansion Americas services or benefiting from Expansion Americas services designed by our company. Such relationships are normally governed by a contract between Expansion Americas and its business partners and Expansion Americas is not responsible for the personal or business information collection practices of such third parties. In this circumstance, please carefully read privacy statement of your respective business partner to whom you disclose your data. Nonetheless, Expansion Americas provides the controls and resources described in this policy so you can, if any local data protection law applies to the processing of your information, exercise your right to:

Personal or Business information we collect

Business information we collect directly from you: (i) name and job title, ii) contact information including public or office email address; (i) company phone or direct phone number (business contact primarly); and (iv) areas of interest, including marketing contact preferences. We intend not to collect personal information, but business information data.

We collect the above information, for example, when you (i) purchase our services; (ii) complete forms on our Sites; (iii) create user account on our Websites or within our Apps or Social Media ;(iv) visit our offices; (v) participate in our promotions, offers, quizzes, questionnaires, and/or contests; (vi) provide us with feedback, leave a product review or contact Expansion Americas with questions or comments.

Personal or business information we collect via our Sites: (i) account information, including online identifiers such as account name and encrypted password. (ii) IP address, device ID, device model; (iii) application usage patterns such as time of activity; (iv) browser information; (iv) geo-location data; (v) profile photos; (vi) Social Media identifiers; (vii) comments, reactions and opinion expressed in Social Media posts.

We collect the above information, for example, when you (i) create a user account on our Website and in the Apps; (ii) order and pay for Expansion Americas services (iii) make use of our Websites, Apps and interact with us via Expansion Americas’s Social Media accounts.

Our Websites and Apps may use information coming from and collected through usage of cookies, tracking pixels, beacons and other tracking technologies.

Personal or business information we collect about you from licensed third parties or by research from our in-house research team: in some circumstances, we collect personal or business information about you from our business partners or from publicly available sources. Such information normally includes contact information (e-mail address, phone number), job title or commercial interests. We then may combine such information with other information we collect directly from you, as described above. We are focused on business data (public data or direct validation) not consumer data, as our approach are solely B2B businesses.

Why we collect your personal or professional information

The purposes for which we collect your personal and business information vary depending on the circumstances of collection. We may process your information for the following business and commercial purposes:

When you order our services: we collect your personal information in order to perform our business relationship with you, including (i) create your account; (ii) manage your orders, including payment; (iii) provide you with customer and technical services; (iv) respond to your questions, enquiries and complaints.

When you use our Websites and Apps (if any): we collect your personal information in order to manage Websites and Apps, including (i) activate your account; (ii) process payments and fulfill orders that you place on or through the Websites or Apps; (iii) allow you to store, share, and/or delete photos or images that you submit, generate and/or save; (iv) troubleshoot software issues, security and operational problems.

When you access our Social Media sites: we collect your personal information in order to manage your interaction with us via our Social Media sites, including (i) administer Social Media sites and fanpages, on the terms and conditions set out by Social Media sites providers; (ii) inform you about our activity; (iii) promote events, brands, products and services; (iv) communicate with you via available functionalities (comments, in-site messages).

When we wish to improve our services: we collect your personal information in order to generate valuable insights so that we can improve our services, including: (i) understand your needs as our customer; (ii) customize your user experience; (iii) measure effectiveness of communications and Websites and Apps performance; (iv) compile market insights; (v) conduct data analysis and testing on the Websites and Apps.

When we promote our services: we collect your personal information in order to periodically reach out to you via different channels with promotional materials, including: (i) engage in direct marketing by email, post and phone; (ii) administer and process surveys, quizzes, questionnaires and contests; (iii) provide you with offers, samples, invitations to events, training courses; (iv) provide you with advertisement information which we have a reason to believe you may find interesting based on your previous requests or based on similar services you have bought or expressed your interest before.

When we attend to our legal obligations: we collect your personal information when the law requires us to do so, including (i) maintaining our business records; (ii) preventing fraud; (iii) complying with the requests of public authorities; (iv) complying with export control and sanctions regulations; (v) abiding by health and safety laws and protocols.

When we share your personal information and with whom

Except as noted herein, we do not sell or share your personal information with any person or entity outside of Expansion Americas.

We may share your personal information and other data with third parties as follows:

Expansion Americas external consultants may be recipients of your personal information, so that we can benefit from our corporate structure to facilitate quicker and more efficient service to you by sharing within the group information systems, financial administration or other administrative tasks and customer service.

Expansion Americas' clients are sometimes subject by Expansion Americas to receive under an agreement, the access to your personal (only if it is public, it is compliant and only regards to the direct phone number contact) or business information. This clients include are not limited to conduct promotional and marketing activities or execute communications. However, our clients are prohibited by agreement, to transmit, send, reproduce, sell or deliver this information to third parties, and are committed to fulfill local and/or international laws in terms of privacy policy.

In case of a legal requirement, Expansion Americas may also disclose your personal and business information and other data to relevant third parties if we are required to do so by law or that disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) identify, contact, or bring legal action against someone who may be violating an agreement they have with Expansion Americas; or (iii) to avoid imminent physical harm to any person or to protect Expansion Americas's rights, safety, or property. We may also disclose your personal information to relevant third parties (e.g., forensics investigators, external legal counsel, law enforcement) to investigate, respond to, and/or to prevent a security/data breach, or to cooperate with government or law enforcement authorities pursuant to other legal matters.

In the course of corporate transactions, Expansion Americas may share your personal information and other data with a third party (and its attorneys, accountants and other relevant parties) in the event that Expansion Americas merges with, acquires, is acquired by, or becomes a legal affiliate with, such third party, or should such a transaction be proposed.

Security

The security of your personal and business information is important to Expansion Americas. Expansion Americas protects personal information by using, implementing, and maintaining industry standard physical, organizational and technological safeguards and security measures that are reasonably designed (appropriate to the sensitivity of such personal information) to help protect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access of personal information in both storage/rest and in transmission. Expansion Americas requires complex passwords for user accounts through the Websites and/or Apps. When your personal information is no longer required (as described in this Statement), it is destroyed, anonymized, or otherwise disposed of using secure methods.

Retention period

Your personal and business information will only be retained by Expansion Americas for as long as it is required: (i) for the purpose(s) for which it was collected; (ii) to be retained by law; and/or (iii) to address any issues that may have arisen at a later date (in which case we will provide you with any further information as required by law).

Expansion Americas reserves the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted by law, even if such records contain your personal information.

Children Information

Our Sites are intended for individuals 18 years of age and older. Expansion Americasdoes not knowingly collect or use information, including personal information, on children under the age of 18. If Expansion Americas becomes aware of any information collected from a child under the age of 18 through the Sites, Expansion Americas will delete the information.

Expansion Americaswill not use a minor's personal information to market or advertise certain products or services deemed harmful to children. Expansion Americasalso will not disclose any minor's personal information if it has actual knowledge that the minor's personal information will be used for the purpose of marketing or advertising the harmful products or services.

Your rights and choices

We provide you with choices regarding the use of your personal and business information for marketing purposes. If you would like to opt out of receiving further promotional emails from Expansion Americas, please follow the opt-out instructions at the bottom of the email or submit a request to sales@expansionamericas.com. Please note that if you have an account with us or you (or your employer or company) have purchased our services recently, we may still contact you with service related information.

International Transfers

Due to geographical proximity of our business to our customers, we generally use and store your personal information within your country of residence. However, as an international company, Expansion Americas may transfer your personal information throughout our worldwide organization or to engage third party service providers based in countries outside of your country of residence. Expansion Americas is committed to comply with international laws.

External Links

While on the Sites, you may choose to follow links to other external online locations, including those embedded in third party ads or sponsor information, which are not controlled by Expansion Americas. Be aware that other online locations may collect and use personal information differently than Expansion Americas on the Sites, and operate in accordance with their own privacy policies. Expansion Americas is not responsible for the privacy practices and data collection policies/practices of such third-party locations. Expansion Americas may also allow interaction between the Sites, and other sites or mobile applications such as Facebook or other social media providers. This may include the "Like" button or other plugins available through the Sites that allow you to share information with persons outside of the Sites. Please consult the privacy policies of those third-party providers before using them to make sure you are comfortable with the level of sharing.

Both privacy laws and Expansion Americas business operations are extremely dynamic in nature. As a result, in the interest of transparency, we reserve the right to make changes to this Statement at any time. We suggest that you check back from time to time in order to understand how we treat your personal information. Our statement’s effective date will always be set forth at the end. Any changes will be immediately incorporated into this Statement and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so.

Your continued use of the Sites or interaction with Expansion Americas after any changes are made to this Statement constitutes your acceptance of the changes. For majority of our processing operations, we rely on Expansion Americas’s legitimate interests, necessity to perform a contract with you, or attending to Expansion America’s legal obligations. In limited circumstances, we may also ask for your consent to process personal information. We list below the purposes of processing, as related to each lawful basis:

Processing on the basis of our legitimate interest. Our legitimate interests may include: (i) handling and responding to your questions, enquiries and complaints; (ii) understanding your needs as our customer; (iii) customizing your user experience; (iv) measuring effectiveness of communications and Websites and Apps performance; (v) compiling market insights; (v) conducting data analysis, testing and troubleshooting on the Sites.

When you are our active customer we use legitimate interest as a lawful basis to (i) engage in direct marketing by email, post and phone; (ii) provide you with offers, samples, invitations to events, training courses; (iii) provide you with advertisement information which we have a reason to believe you may find interesting based on your previous requests or based on similar products you have bought or expressed your interest before.

Processing on the basis of performance of a contract: we normally process your personal or business information on the basis of contract performance when we need to take preparatory steps prior to a conclusion of a contract with you or in order to manage our contractual relationship such as sale of our products. Examples include: (i) creating your account, including on the Sites; (ii) managing your orders, including payment; (iii) process payments and fulfill orders that you place on or through the Websites or Apps; (iv) provide you with customer and technical services.

Processing on the basis of your consent: the typical activities that we would ask your permission for include: (i) direct marketing activities, as described below; (ii) targeted advertising; (iii) adjusting or turning on settings of your mobile phone when using Expansion Americas Apps to, for example, turn on your camera or use your geolocation, always to offer you better service.

When you are a prospective client of Expansion Americas, we ask you for a permission to (i) engage in direct marketing by email; (ii) provide you with offers, samples, invitations to events, training courses; (iii) provide you with advertisement information that you have expressed your interest in at the moment of granting consent.

Processing on the basis of our legal obligation: we may ask you to provide certain personal information or obtain it from third parties when the law requires us to do so or it is indispensable to attend to our legal obligations. Examples include: (i) maintaining our business records; (ii) preventing fraud; (iii) complying with the requests of public authorities; (iv) complying with export control and sanctions regulations; (v) abiding by health and safety laws and protocols.

Transfers outside of EEA

In general, given the geographical proximity of our business with our clients, we use your personal or business information within your country or another member state of the European Union. However, as an international company, Expansion Americas may transfer your personal information throughout our worldwide organization or engage third party service providers based in countries outside the European Union. Some of these countries may not be regarded as ensuring an adequate level of protection with regard to the processing of your personal information. In such cases, we do not transfer your personal information unless we have provided appropriate safeguards such as data processing agreements on the basis of standard data protection clauses adopted by the EU Commission (which Expansion Americas has implemented for transfers to its group entities in the U.S., for example). GDPR provides EEA individuals with specific rights regarding their personal and business information. More specifically, you have the following rights regarding Expansion Americas’s collection, use and sharing of your personal information:
